Feinberg looks to create new factors for BP Claims and want`s to pay Moratorium Claims

It is only fair for the GCCF under the direction of Ken Feinberg to adjust their Methodology. Currently Oystermen are given up to 7 times their 2010 losses.

Feinberg is also rethinking his stance on moratorium claims and with BP`s permission he wants to include them into the BP Claims process. This would be a blessing to many that lost most of their income due to BP`s negligence. There would never have been a moratorium if BP had not caused the biggest Oil Spill in U.S. history. The Baton Rouge Area Foundation was suppose to pay these claims, but instead denied many. If Feinberg takes charge of this, and indeed makes things right, it would be significant move of good will by Mr. Feinberg. Couple this with a possible change in methodology for people in the Gulf Seafood Industry, and we could be seeing a significant shift in Mr. Feinberg`s historical positions.

BP Class Action and the Misperception

The BP Claims process and the pending litigation is not by any means  going to be settled as a class action. There is common misconception  that anytime there is a large number of plantiffs that it has to be a  class action..such is not true. Though cases and claims may get settled  in mass, in the end the plantiff has the right to say yes or no. This is  what makes it different than a class action; a judge will not determine  how much you receive. You will have the right to proceed to trial,  negotiate your own deal, or accept what is offered. In a typical class  action, the judge determines what the claimants receive after a trial  with a few representative plaintiffs.

BP investigator laments ‘nobody in charge’

Federal investigators became visibly annoyed Thursday as BP executives were unwilling or unable to provide a clear picture of the company’s hierarchy or say who was in charge of the rig leased by the oil giant the day it blew up.

“Everybody in charge, nobody in charge,” U.S. Coast Guard Capt. Hung Nguyen, co-chairman of the investigative board, said in frustration after repeatedly questioning BP senior vice president Kent Wells about who oversaw safety on the Deepwater Horizon, and the company as a whole.

“I disagree,” Wells responded, explaining that BP aimed to instill a company-wide safety culture that ensured every employee felt responsible.

Other high-level BP employees testified during a fourth day of hearings in Houston, revealing a major managerial restructuring — including the replacement of a top rig official just four days before the Deepwater Horizon exploded — led to confusion in the days before the rig exploded April 20, killing 11 people.

The testimony also revealed that key work procedures on the rig may have been changed in the days and even hours before the blast, possibly without receiving the necessary federal approval. Furthermore, David Sims, BP’s drilling and completions operations manager, testified that a move from a paper to electronic system for filing major decision changes caused further confusion and was a “painful” process.

Attorneys and the joint panel of the U.S. Coast Guard and the Bureau of Ocean Energy Management, Regulation and Enforcement spent the bulk of the hearings seeking basic information about BP’s personnel structure. Yet those details remained out of reach, with Nguyen and other board members repeatedly voicing their frustration.

Lawyers from BP, rig owner Transocean, victims and others have also been quick to object to questions. Those testifying often gave vague answers or simply said: “I don’t recall.”

So-called ‘golden rules’
Wells, who has been key to BP’s efforts to plug the largest oil spill in U.S. history, told the panel repeatedly he had not asked questions or interested himself in what led to, or possibly triggered, the April 20 explosion that killed 11 people. He said this was to ensure he would be fully focused on the response.

Asked repeatedly if there was any one person in the company responsible to enforce its so-called “golden rules” of safety, he said “our culture is meant that everyone is supposed to feel responsible.” No matter how the question was posed, the answer remained largely the same.

The answer to this very heavy search terms is YES. You can file a claim against BP and the others involved with the 2010 oil spill from now until forever into the future if you become damages from the oil spill. The GCCF will only accept claims until August 23 2013, but if you get sick in 10 years and want to file a claim talk to an attorney then and you can file a claim.

Proximity, Perception and the Gulf Coast Claims Facility

The GCCF often points out that if they can not connect the loss to the spill, they can not pay the claim. The fact of the matter is the GCCF does not often consider the perception that many areas along the Gulf Coast, whether tainted by oil and dispersant or not, were all affected by BP Oil Spill.
 
Proximity to the spill is one of the key factors the GCCF takes into consideration when paying a claim, perception is something that the GCCF would rather not factor in. Yet if you ask me, and mind you I am not an Attorney, perception needs to be fully figured in when calculating your GCCF Claim. Many destination areas from the Florida Keys to Houston, and across the Gulf Region were devastated as the reports of tar balls and oil hitting the loop current were on the nightly news feeds.
 
To say the least, the perception of a tainted Gulf of Mexico put a damper on anyone visiting Gulf Side Communities. One of the hardest hit areas was the Florida Keys, who can usually count on a steady stream of tourists. Many  GCCF claims  have been denied because the GCCF is using proximity, as they choose to forget the perception painted by the nightly news, that their Oil Spill caused.

Casino Claims and the GCCF

From some of the grumblings I hear, the GCCF is getting ready to release a formula for Casino Workers.
Casino workers claims were originally excluded  by the GCCF as I understand it, then were given some leeway within the GCCF Claims process, and now are getting their own formula to figure out their estimated loss the GCCF way. Since the GCCF is recognizing the Casino Workers affected by the Oil Spill and creating a methodology for them, it is a plus. In my opinion their claims have been overlooked by the GCCF, and some Attorneys  chose not to take them. I like the Attorneys who decided to take them out of the gate, because they saw the connection, and these people needed help.  Oil Spill Attorneys that realized the connection, or nexus as they call it have a clearer understanding of what it takes to get a casino workers claims through, as they have more experience doing it. I would expect to see a wave of Attorneys taking casino workers cases or claims now, what I might ask is if they had been accepting cases since the beginning.
